Allowance for the job assistant activity - § 59

The Office will provide, based on a written request, pursuant to the employer, who employs a person with health handicap, or self-employer, who is a person with health handicap, allowance for the activity, if the necessity of such job assistant results from the kind of health handicap and performed work of employee or self-employer. The part of the this request is   data about per cent rate of capability decrease to perform the gainful activity by the person with health handicap, characteristics of work performed by the employee or self-employer  on the work station and work hour duration, justification of necessity of a job assistant and characteristics and scope of the job assistant activities. 

The job assistant for the purposes of this act is: 

- An employee who provides help to an employee or employees, who are persons  with health handicap, when performing work activities and personal needs during the work hours, 

- Physical entity, which provides help to a self-employer being a person  with health handicap, when performing or operating the self-employed gainful activity and personal needs during the  performance or operation of the self-employed gainful activity.

The job assistant shall be minimum 18 years old and capable for legal acts. 

The allowance is provided monthly, in the minimum amount of 41 % and maximum amount of 70 % of the total work price (in 2013 from 433,46 EUR to 740,06 EUR) calculated from the average salary of an employee in the economy of the Slovak Republic for the first up to third quarter of the calendar year preceding the  calendar year, in which the agreement for one job assistant is concluded for the duration of

- of labor relation of an employee , who is a person with health handicap or employees, who is a persons with health handicap being in personal care of the job assistant, 

- Performance or operation self-employed gainful activity by a person, who is a person with health handicap.

The allowance is provided pursuant to a written agreement related to allowance provision concluded between the Office and the employer, who employs a person with health handicap, or between the Office and the self-employer, who is a person with health handicap. The allowance is provided by the Office, in the territory in which a person with health handicap performs the work or operates or performs the self-employment. .

Self-employer, who is a person with health handicap, concludes with a job assistant a contract related to support when operating or performing the self-employment, with one contract copy submitting to the competent Office.
