Office of Labor, Social Matters and Family (hereinafter referred to as „Office“) may provide to a person with health handicap an allowance for self-employed gaining activity (hereinafter referred to as „allowance for self-employment“) for partial compensation of costs related to operation of self-employed gainful activity (hereinafter referred to as „self-employment“) to following job seeker who is a person with health handicap:   

- who was registered in the job seeker register at least 3 month;

- who was registered in the job seeker register at least  12 months  in the case that the job seeker suspended, discontinued or finished the  self-employment operation,

- self-employment activity,

- Who will be a self-employer operating a self-employed gaining activity (hereinafter referred to as „self-employment“) on a sheltered workstation in accordance with the Act No.  455/1991 of the Code related to Trades as amended by later regulations, 

- or who will be a  self-employer operating the  self-employment on a sheltered workstation, performing agricultural production inclusive of economy in forests and water surfaces in accordance with  §§ 12a up to 12e of the Act No. 105/1990 of the Code related to private business of citizens as amended by later regulations,

- Who presents a written request,

- Who will operate the self-employment on a sheltered workstation minimum two years consecutively.  

The allowance is not provided to a job seeker, who is a person with health handicap, to whom the allowance pursuant to § 49 of the employment service act has been provided. The allowance is not provided to settle the insurance premium advance money for obligatory public health insurance, insurance premium for social insurance and obligatory contributions for retirement pension savings paid by the self-employer who is the person with health handicap and for hire cost settlement. 

The allowance is provided by the Office, in the territory of which a person with health handicap establishes a sheltered workstation, in which the self-employment will be operated. Written request to provide the non-repayable financial allowance is to be submitted by a job seeker with health handicap to the Office in the territory of which the self-employment will be operated in a sheltered workstation.

Obligatory appendices inclusive of business plan together with cost calculation for operation of the relevant self-employment being a part of the allowance request after submitting are an allowance request part.  (see the Appendix “Allowance provision request”). 

The Office assures to a job seeker, to a person with health handicap, pursuant to his/her request a training to start the self-employment operation on a sheltered workstation. A part of this training is the elaboration of business plan inclusive of all expected costs for establishment of a sheltered workstation. The above mentioned documents shall be a base to judge the request by the commission of the Office established by the Committee for issues of employment of the Office. 

Job seeker, after fulfilling all obligations determined by the law, concludes with the relevant Office an agreement related to allowance provision, by which the job seeker is obliged to start the self-employment operation on a sheltered workstation a this operation shall continue minimum two years uninterruptedly in accordance with the submitted request, business plan and cost calculation. The allowance is provided for compensation of costs related to operation of self-employment mentioned in the business plan and shall be used within the period from the operation of signed agreement up to finish of self-employment operation obligation.

Allowance amount depends on the total work price, region type legitimate for government support and average of registered unemployment rate in a county, in which the relevant person will perform the self-employment. Allowance amount to a person with health handicap for self-employment in sheltered workstation since 1 May 2013:

For partial compensation of costs related to the self-employment operation, the Office will provide 30 % of the admitted claim within 30 calendar days from the day of concluding an agreement related to allowance provision and the remaining part, i .e. 70 % of admitted claim after submitting the documents for the amount of minimum 30 % of admitted and already provided allowance. Afterwards, the allowance recipient is obliged to submit to the Office even further remaining documents to that all documents related to self-employment documentation up to 100 % of the allowance provided shall be submitted not later than 6 months from the concluding the agreement related to allowance provision because it is the question of allowance to be used by the recipient to establish a job, where the self-employer shall be operate a self-employment. The Office determined the date to the allowance recipient, on which the documents related to use of provided allowance shall be submitted. The documents shall not be submitted later than within 6 months from the date of agreement concluding.  Failing to submit the above mentioned documents in accordance with the above mentioned conditions is considered to be a significant violation of agreement conditions. 

For each year of the self-employment operation on a sheltered workstation, during the two-year period of self-employment operation, the recipient of the allowance shall submit a self-employment operation report and provided allowance drawdown.

The first self-employment report and report of provided allowance drawdown within the relevant period shall be submitted by the allowance recipient after elapsing of 12 months of self-employment operation not later than within 3 month from the finish of 12 month self-employment operation.  

The second self-employment operation report and report of provided allowance drawdown within the period of the second year of self-employment operation shall be submitted by the allowance recipient not later than within 3 month from the finish of 24 month self-employment operation. 

There is no legal claim of allowance for a person with health handicap to perform the self-employment on a sheltered workstation. 

The allowance may be provided repeatedly not earlier than after elapsing of 8 years from the start of self-employment for which the allowance was provided to this person.
