Children and divorce (separation)

Exercise of parents´ rights and obligations towards an under-aged child should be regulated after divorce/ separation.

If under-aged child´s parents are a married couple:

In the divorce verdict, the Court shall rule out to whose care an under-aged child will be entrusted, who will represent the child and administer his estate. The other parent will be ordered to pay maintenance or the Court shall approve the parents´ agreement on the maintenance amount or entrust the child in shared personal care by both parents if it is in the child´s interest.  

If under-aged child´s parents are not a married couple:

In the divorce verdict, the Court shall rule out to whose care an under-aged child will be entrusted, who will represent the child and administer his estate. The other parent will be ordered to pay maintenance or the Court shall approve the parents´ agreement on the maintenance amount or entrust the child in shared personal care by both parents if it is in the child´s interest. 

In both above cases, if the parents agree on the regime of contacts with the child, the agreement will become an integral part of the decision on regulation of the parent´s rights and obligations exercising towards the under-aged child or of the divorce verdict and regulation of the parent´s rights and obligations towards the under-aged child for period after divorce.

If the parents don´t reach agreement on the regime of contacts with the child after the divorce, the Court shall regulate the contacts with under-aged child in the divorce verdict and the decision on the parent´s rights and obligations exercising towards the under-aged child for period after divorce.

Children are deeply affected by the parents´ divorce. Passing through major life change, they need both parents as well as close relatives to understand better what will change and what remains the same in their lives. Well-known statement says that after divorce you are not spouses anymore but remain parents. RPPS psychologist can help the divorcing parents, if interested, to remain such parents for their children, who:

-          are able to agree on common children´s raising in security and confidence after divorce/ separation

-          are able to keep communication, solve misunderstandings, settle conflicts and make the parent agreement on remaining good parents to their children

-          are able to accept each other and stay close if they participate on the children raising and care in any form.  

If the parents noticed their child suffering from the post-divorce/ separation development at home, RPPS consultant – psychologist can be a specialist who will help children to orientate better in the world of emotions, various thoughts and suffering, to gradually accept and psychically adapt to ongoing changes in the children´s lives.  The psychologist helps a child to better understand and accept new facts in the family, emotions and the strategy of overcoming daily problems, to accept and manage also unpleasant topics associated with the divorce. 

Are these services confidential?

All services provided by RPPS psychologist are confidential and psychologist´s performance at RPPS follows the Act No. 199/1994 Coll. on Psychological Activity and SR Chamber of Psychologists,  Act No. 428/2002 Coll. on Personal Data Protection and Act No. 305/2005 on Social-Legal Protection of Children and Social Tutorship.

Along with the law, the psychologist also follows the Ethical Codex of the Advisory-Psychological Practice, Department of Advisory-Psychological Services, the Office of Labor, Social Matters and Family SR. Information share extent at the meetings with RPPS psychologist  is determined by the contract between those coming to the psychologist, evtl. those who have recommended/ ordered psychological services and the consulting RPPS psychologist.
