Leave a parent with a child to abroad

If a parent and his child leave to abroad (vacation or long-term stay), the other parent should be informed on and agree with this fact in written form. Should the other parent disagree with such leave, the case could refer to unauthorized relocation or keeping the child outside of the country of his usual stay. It would mean that one parent removed the child from the other parent´s care and raising and thus disabled him to contact his child. 

Situation can occur when a parent has had his child entrusted in his care and he leaves to abroad. Entrustment of a child in care doesn´t authorize the parent to exclusively decide about the child. If the other person´s parental rights aren´t restricted/ he wasn’t divested his parent rights, this parent remain the child´s parent / legal representative and is entitle to participate on the decision on the child´s life. In such cases, the other parent must be informed on the child´s leave and agree with it (recommended written agreement form). 

If it isn´t the case (parent and child leaving without the other parent´s consent), we recommend contacting the Center of International Legal Protection of Children and Youth being competent to adopt necessary measures in the area of international children hijacking.
