Foster care

(Section 48 of the Act No. 36/2005 Coll. on the Family)

Where parents do not ensure, or cannot ensure personal care of an underage child, and where it is in the best interests of the minor, the court may decide to entrust the child in foster care of an individual interested in becoming a foster caregiver and meeting the prescribed prerequisites  (hereinafter referred to as a "foster parent").

A foster parent can only become:

1. a natural person with permanent residence in the territory of the Slovak Republic,

2. a natural person having legal capacity for legal acts in full scope,

3. a natural person having personal prerequisites,

   a. particularly  relating to health,  

   b. personality and

   c. morals,  

4. a natural person having been  filed in the list of applicants for foster care, subject to a special regulation (Act No. 305/2005 Coll. on the Social and Legal Protection of Children and Social Curatorship and on amending of certain acts)

5. a natural person who,  with his or her life style and that of the persons living with him or her in the household  guarantees to undertake foster care in the bets interests of the underage  child.
