What is social curatorship

Social curatorship is a system of measures to eliminate, mitigate or avoid deepening or recurrence of the psychical, physical and social development disorder of a child, and of an adult and to provide assistance, depending on the gravity of malfunction, and the situation in which the child or the natural person of age find themselves.

Measures of social and legal protection of children and social curatorship are implemented:  

a) for a child  that 

1. has permanent residence in the territory of the Slovak Republic, temporary residence,  temporary residence permit, permanent residence permit, or that has been granted tolerated stay  (hereinafter referred to as  "ordinary residence"), or for the child for whom the ordinary residence cannot be determined, 

2. is a citizen of the Slovak Republic and is in the territory  of another state,

3. is not a national of the Slovak Republic and is in the territory of the Slovak Republic, unaccompanied  by the parent, or another  person of age in whose personal care the child could be placed (hereinafter referred to as  "unaccompanied minor"),

4. is a juvenile,  subject to a special regulation, (the Criminal  Code)

b) for an adult  person of up to 25 years of age that has ordinary residence in the territory of the Slovak Republic  (hereinafter referred to as "young adult"),

c) for other natural person  of age  that has ordinary residence in the territory of the Slovak Republic.

Implementation of measures of social and legal protection of children and social curatorship  

Measures of social and legal protection of children and social curatorship are implemented for the child, natural person of age, family, group and community, particularly through social work, the methods, techniques and procedures reflecting the knowledge of social sciences and the knowledge on the state and the development of social pathology phenomena in the society.

Measures of social and legal protection of children and social curatorship build on and condition one another. In the choice and implementation of measures preference is given to the measures ensuring the upbringing and the general development of the child in his or her  natural family environment, or in an alternative family environment. 

Measures of social and legal protection of children and social curatorship are implemented, unless this act provides otherwise, 

1. in a  natural  family environment, which is the home environment  of the child, family or the natural person of age. Where it is appropriate and expedient, measures in pursuance of this act, are also implemented in a broader social environment of the child, family, or the natural person of age and in the households of individuals that are in kinship, or have a close relationship with them.

2. in an alternative family environment, which is the home environment of the natural person of age, in whose care the court has entrusted the child, or in whose care the child was temporarily placed by a decision of the authority of social  and legal protection of children and social curatorship.

3. in open environment, which is any open space, public structure, or communication which, for individuals and groups, is  the natural social environment  in which they ordinary stay and the mobile, or stationary spatial backgrounds of individuals and groups.

4.  in an environment set up and arranged for the execution of measures under this  act  - a facility of social and legal protection of children and social curatorship.
